These terms and conditions ("Terms") govern your use of the managed website service provided by Launch My Local Site ("we", "us", "our"). By placing an order or using our service, you ("the Customer", "you") agree to be bound by these Terms. Please read them carefully before proceeding.

1. Service Description

Launch My Local Site provides a managed website service for local businesses, sole traders, and small brands. Our service includes the design, build, hosting, and ongoing maintenance of a professional website tailored to your business.

The core service includes tailored website copy written on your behalf, essential website pages, domain name registration and hosting, mobile-friendly responsive design, search engine friendly setup with Google submission on launch, GDPR-compliant cookie consent, and ongoing maintenance and updates for the duration of your plan.

Optional extras such as logo design, contact forms, blog setup, blog writing, Google Ads management, map listings, image packs, and bespoke requirements are available at additional cost as outlined during the quote process.

2. Pricing and Payment Terms

The core managed website service is priced at £99 per month. All prices are inclusive of VAT where applicable.

  • Minimum term: The initial contract period is 12 months from the date your website is launched.
  • Monthly rolling: After the initial 12-month term, the service continues on a monthly rolling basis at the same rate unless otherwise agreed.
  • Annual payment option: You may choose to pay annually in advance and receive a 20% discount on the monthly rate, resulting in a payment of £79 per month (billed as £948 for the year).
  • Optional extras: Any extras selected during the quote process will be charged as one-off fees or added to your monthly plan as described at the time of order.

We reserve the right to adjust pricing at the end of your current contract term. You will be given at least 30 days' notice of any price changes.

3. Payment Timing

No payment is required until your website has been built, reviewed, and approved by you for launch. Your first payment is due only once you have given written approval (by email) for your site to go live.

Ongoing monthly payments are due on the same date each month following your approval date. Payments for annual plans are due in full at the start of each 12-month billing period.

If payment is not received within 14 days of the due date, we reserve the right to suspend your website until the outstanding balance is settled.

4. Service Delivery and Timelines

We aim to deliver a preview of your website for review within a reasonable timeframe, typically within 10 working days of receiving all required information from you. Timelines may vary depending on the complexity of your requirements and the responsiveness of your feedback.

One round of revisions is included in the core package. Additional revision rounds may be subject to an additional charge, which we will agree with you in advance.

We are not responsible for delays caused by your failure to provide content, feedback, or approvals in a timely manner.

5. Content and Intellectual Property

Content we create: All website copy, design work, and other materials created by us as part of your service are produced for your use on the website we build and maintain for you. While your plan is active, you have a full licence to use all content on your website.

Ownership on termination: Upon termination of your plan, the written copy created for your website becomes your property. Website design templates, code, and underlying systems remain the property of Launch My Local Site.

Content you provide: You retain ownership of any content, images, logos, or materials you supply to us. By providing this content, you confirm that you have the right to use it and grant us permission to use it on your website.

Portfolio use: We may use anonymised screenshots or descriptions of your website in our portfolio or marketing materials unless you notify us in writing that you do not wish us to do so.

6. Customer Responsibilities

You agree to:

  • Provide accurate and complete information about your business as requested during the quote and build process.
  • Review your website preview and provide feedback or approval within a reasonable timeframe (we recommend within 7 working days).
  • Ensure any content, images, or materials you provide do not infringe the intellectual property rights of any third party.
  • Notify us promptly of any changes to your business details, contact information, or payment details.
  • Not use the website for any unlawful purpose or to publish content that is defamatory, misleading, or harmful.

7. Limitation of Liability

We take pride in the quality of our work and aim to provide a reliable, professional service at all times. However, to the fullest extent permitted by law:

  • Our total liability to you for any claim arising from or in connection with the service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.
  • We are not liable for any indirect, incidental, or consequential losses, including loss of profit, loss of business, or loss of data, however caused.
  • We are not responsible for any loss or damage resulting from factors outside our reasonable control, including but not limited to third-party hosting outages, internet connectivity issues, cyberattacks, or force majeure events.
  • We do not guarantee any specific results from your website, including search engine rankings, visitor numbers, or business enquiries.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

8. Website Hosting and Uptime

Your website hosting is included in your monthly plan for as long as your plan remains active. We use reputable third-party hosting providers and take reasonable steps to ensure your website remains available and performs well.

While we aim for high availability, we do not guarantee 100% uptime. Occasional downtime may occur due to scheduled maintenance, hosting provider issues, or circumstances beyond our control. We will make reasonable efforts to resolve any downtime promptly and keep you informed where appropriate.

If your plan is cancelled or terminated, your website and hosting will be taken offline at the end of your notice period.

9. Cancellation and Termination

During the minimum term: The initial 12-month minimum term is a binding commitment. Early cancellation during this period will require payment of the remaining balance for the term.

After the minimum term: Once the initial 12-month term has ended, you may cancel your plan at any time by providing 30 days' written notice by email to hello [at] launchmylocalsite [dot] co [dot] uk.

Cancellation before launch: If you decide not to proceed before your website has been approved for launch, you may cancel without charge. Any one-off extras already completed (such as logo design) may still be payable.

Termination by us: We reserve the right to terminate your plan immediately if you breach these Terms, fail to make payment within 30 days of it being due, or use the service for any unlawful purpose. In such cases, no refund will be given for any prepaid period.

On termination: When your plan ends, your website will be taken offline and your hosting will cease. We will make reasonable efforts to provide you with a copy of your website content upon request, made within 30 days of termination.

10. Data Protection

We take the protection of your personal data seriously. Any personal information you provide to us will be handled in accordance with our Privacy & Cookie Policy, which forms part of these Terms.

We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For full details on how we collect, use, and protect your data, please refer to our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by placing a notice on our website at least 30 days before the changes take effect.

Your continued use of the service after any changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your plan in accordance with Section 9.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
